These Terms & Conditions ("Terms") govern your use of the BABICHA (Ice Cream & Bubble Tea) website and online ordering application (the "Service"), operated by Babicha PRIVATE LIMITED (CIN No U21000TS2024PTC189150) ("BABICHA", "we", "us", "our"). By accessing the Service or placing an order, you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 18 years old, or using the Service under the supervision of a parent/guardian, to place an order. By using the Service, you confirm the information you provide is accurate and that you have the authority to make payment for your order.

• You may need to create an account with your name, phone number, and email to place orders.
• You are responsible for maintaining the confidentiality of your login details and for all activity under your account.
• Notify us immediately of any unauthorized use of your account.

• All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including due to item unavailability, pricing errors, or suspected fraudulent activity.
• Prices, menu items, and offers are subject to change without prior notice and may vary by outlet or time of day.
• Order confirmation will be shown in-app and/or sent via SMS/email once your order is accepted.

• All prices are listed in Indian Rupees (₹) and are inclusive/exclusive of applicable taxes as shown at checkout.
• Payment can be made via the methods offered in the app (UPI, cards, net banking, cash on delivery where available).
• Online payments are processed by third-party payment gateways; BABICHA does not store your full payment credentials.

Cancellations, refunds, and replacements are governed by our Refund & Cancellation Policy, which forms part of these Terms.

Delivery timelines, areas, and charges are governed by our Shipping & Delivery Policy, which forms part of these Terms.

• We take reasonable care in preparing our products, but items may be prepared in an environment that also handles common allergens such as milk, nuts, gluten, and soy.
• If you have food allergies or dietary restrictions, please check with us before ordering, using the contact details below.
• Product images on the app are for representation purposes; actual presentation may vary slightly.

You agree not to:

• Use the Service for any unlawful purpose or to submit false or fraudulent orders.
• Attempt to gain unauthorized access to our systems, other user accounts, or data.
• Misuse promotional offers, coupons, or referral programs.
• Harass, abuse, or threaten our staff or delivery partners.

All content on the Service — including the BABICHA name, logo, menu descriptions, images, and app design — is owned by or licensed to BABICHA and may not be copied, reproduced, or used without our prior written consent.

To the maximum extent permitted by law, BABICHA shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, delays in delivery, or issues caused by third-party payment or delivery providers, except where such liability cannot be excluded under applicable law.

The Service may rely on third-party providers (payment gateways, delivery partners, SMS/notification services). We are not responsible for outages, errors, or issues arising directly from these third-party services, though we will assist in resolving order-related issues where possible.

We may update these Terms, the app, or menu offerings at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
